§ 1 Scope of Application

These General Terms and Conditions (hereinafter "GTC") apply to all legal transactions between Studio Negativ Maselli, Jurastrasse 1, 3013 Bern, Switzerland (hereinafter "Studio Negativ") and customers (hereinafter "Customer"), including both private consumers (B2C) and business customers (B2B).

These GTC apply to the online shop, camera rental, repair service, in-store purchases, as well as booked photography courses and consultation appointments, regardless of whether the contract is concluded online, by telephone, by e-mail, or in person at the store.

Studio Negativ reserves the right to amend these GTC at any time. The version in force at the time of the order or booking shall apply.

§ 2 Conclusion of Contract

An order, booking, or enquiry by the Customer constitutes a binding offer to enter into a contract. The contract is concluded as soon as Studio Negativ confirms the order or booking in writing by e-mail, or delivers the goods or renders the service.

If Studio Negativ does not send a written confirmation within 10 calendar days of the Customer's order, the Customer shall be released from their offer.

Amendments or cancellations after conclusion of contract are only valid with Studio Negativ's written consent and may be subject to processing fees.

§ 3 Customer Obligations

The Customer undertakes to provide complete and accurate information when placing an order, making a booking, or submitting a repair request. Errors or omissions by the Customer that result in additional costs or damage shall be borne by the Customer.

Upon conclusion of the contract, the Customer assumes the following obligations:

Obligation to accept: The Customer is obliged to accept the ordered goods or booked service at the agreed time. Unjustified refusal of acceptance entitles Studio Negativ to charge the resulting costs (return shipping, storage, handling).

Payment obligation: The Customer is obliged to pay the agreed price on time. In the event of late payment, the provisions of § 6 (Payment Terms) apply.

Notification obligation: Defects, incorrect deliveries, or damage must be reported in writing immediately and no later than within the deadlines stated in the relevant sections. Late notification may result in the loss of warranty claims.

Duty of care for rental equipment: The Customer is obliged to handle rented equipment with care and in accordance with its intended use. Damage caused by improper use is entirely at the Customer's expense (see also § 8).

Prohibition on subletting: Rented equipment may only be used by the Customer personally. Subletting, transfer, or use by third parties is prohibited without the prior written consent of Studio Negativ.

Obligation to collect after repair: The Customer is obliged to collect their device within 30 calendar days of being notified that the repair is complete. After this period, Studio Negativ is entitled to return the device at the Customer's expense (see § 9).

§ 4 Product Range & Prices

Studio Negativ offers both new and used cameras, lenses, and accessories. All offers are valid while stocks last. Images, descriptions, and technical specifications in the online shop are non-binding and may be updated at any time. Typographical errors and mistakes are reserved.

All prices are quoted in Swiss Francs (CHF). Studio Negativ is not subject to VAT; prices shown are final prices with no separate VAT charge. Should VAT liability arise in the future, prices will be adjusted and clearly displayed accordingly.

All products — new and used alike — are classified using Studio Negativ's standardised Condition Rating. Our rating classifies the equipment's optical, mechanical and cosmetic condition, providing a clearer overall picture of the product. Each of the three categories is assessed independently:

Optical – condition of lenses, viewfinder, prism, glass elements

Mechanical – condition of functions, mechanics, electronics

Cosmetic – condition of body, surfaces, external appearance

Each category is rated using one of the following grades (highest to lowest):

The Condition Rating is visible on all product listings in the online shop and in-store. By placing an order, the Customer confirms having taken note of the rating and product description. The warranty of conformity pursuant to § 7.2 is based exclusively on the documented rating and the associated product description.

§ 5 Shipping & Delivery

Studio Negativ ships worldwide. Shipments are generally dispatched via Swiss Post or UPS. The choice of carrier is at the discretion of Studio Negativ unless expressly agreed otherwise.

Shipping costs are calculated individually based on the delivery address and order quantity, and are displayed automatically to the Customer at checkout before the order is completed. By completing the order, the Customer accepts the shipping costs shown.

Risk and title pass to the Customer in full upon handover of the goods to the shipping carrier. Studio Negativ assumes no liability or responsibility whatsoever in connection with shipping. This applies in particular to delays, damage, loss, or theft of the shipment during transit, regardless of the carrier used.

All customs duties, taxes, import charges, or other shipping-related ancillary costs for international shipments are borne entirely by the Customer.

Returns not attributable to fault on the part of Studio Negativ, as well as any additional shipping costs incurred (e.g. undeliverable parcels, incorrect address details, refused acceptance), will be invoiced to the Customer.

For unusual shipments that incur additional costs due to weight, volume, or oversized/bulky goods (e.g. heavy lenses, tripods, large format equipment), Studio Negativ reserves the right to request a surcharge after the order has been placed. The Customer will be informed in advance and must agree to the surcharge. If no agreement is reached, Studio Negativ is entitled to cancel the order and refund the full purchase price.

Any delivery time information provided on product listings or on the Studio Negativ website is non-binding and for guidance only. Studio Negativ endeavours to meet these estimates but assumes no liability for delays. Late delivery, for whatever reason, does not entitle the Customer to withdraw from the contract or to claim compensation from Studio Negativ.

Alternatively, orders may be collected free of charge in-store at Jurastrasse 1, 3013 Bern, during opening hours (Click & Collect). The Customer will be notified by e-mail once the order is ready for collection.

§ 6 Payment Terms

Studio Negativ accepts the following payment methods:

– Credit card (Visa, Mastercard)

– Twint

– PostFinance E-Finance (all PostFinance payment options available in the Wix online shop)

– Bank transfer (advance payment)

– Invoice (business customers only, by prior written agreement)

– Cash payment (in-store only)

Payment in the online shop is generally due before dispatch of the goods (advance payment). For business customers, payment by invoice may be granted by prior written agreement. Invoices are payable within 14 calendar days of the invoice date, unless a different term has been agreed in writing.

In the event of late payment, Studio Negativ is entitled to charge a reminder fee of CHF 20.– per reminder level and default interest of 5% p.a. pursuant to Art. 104 CO. Studio Negativ is further entitled to withhold outstanding deliveries or services until all outstanding amounts have been settled in full. In cases of continued non-payment, Studio Negativ reserves the right to refer the matter to a debt collection agency or initiate legal proceedings, with all resulting costs charged to the Customer.

Goods remain the property of Studio Negativ until full payment of the purchase price has been received (retention of title pursuant to Art. 715 CC). Studio Negativ is entitled to register this retention of title in the public register.

§ 7 Warranty & Returns

7.1 New Goods

New products are covered by the manufacturer's warranty conditions. Studio Negativ will assist the Customer in warranty claims vis-à-vis the manufacturer but does not itself assume any manufacturer's warranty. Defects must be reported in writing within 8 calendar days of receipt. Hidden defects must be reported in writing immediately upon discovery, and no later than within the manufacturer's warranty period.

7.2 Used Goods (Second-Hand)

Studio Negativ warrants that used products, at the time of delivery, conform to the documented Condition Rating and the associated product description (warranty of conformity pursuant to Art. 197 CO). The Condition Rating assesses each item across three independent categories — Optical, Mechanical, and Cosmetic — each graded on a scale from Mint to Project. The sole reference for any warranty claim is the documented rating and product description, including any stated defects, signs of use, or limitations.

By placing an order, the Customer confirms having fully taken note of the product photos, the Condition Rating, and the product description. The primary and binding reference for assessing the condition of a product is the full set of product photos — these take precedence as the first point of reference. The Condition Rating (Optical / Mechanical / Cosmetic) constitutes the second reference, followed by the written product description. Minor deviations between the product photos and the item actually delivered — in particular slight differences in colour rendering, lighting, or minimal cosmetic details attributable to photographic conditions — cannot be contested, provided the documented Condition Rating is accurate. No right of return exists for used goods, provided the delivered item corresponds to its photographic representation, rating, and description.

If the delivered item demonstrably deviates from the documented Condition Rating or description, the Customer must notify Studio Negativ in writing within 5 calendar days of receipt. Studio Negativ will assess the matter and decide at its sole discretion whether to remedy the defect, provide a replacement, or issue a partial or full refund.

7.3 Serviced / Revised Products / CLA

Products labelled "ex-service", "revised", or "CLA" (Clean, Lube & Adjust) have been technically overhauled and restored. The service may have been carried out by Studio Negativ itself or by a recognised specialist third party; this is indicated in the respective product listing.

A 3-month warranty from the date of purchase is granted on the work carried out. This warranty covers only the defects remedied during the service. All consequential damages, as well as damage caused by improper use, external influences (including water, moisture, heat, cold, impact, or electrical surges), and consumable parts (in particular batteries, seals, lubrication) are expressly excluded.

7.4 Exclusions & Right of Assessment

All warranty and guarantee claims are excluded for damage or defects attributable to: improper use or storage; use of incompatible accessories or spare parts; unauthorised repairs or modifications by the Customer or third parties; external influences such as impact, moisture, water, heat, cold, or electrical surges; and normal wear and tear.

All consequential damages — of any kind and cause — are excluded from warranty. Studio Negativ expressly reserves the right to independently assess and make a final determination on any warranty or guarantee claim. Studio Negativ's decision is binding on the Customer, unless mandatory statutory provisions provide otherwise.

7.5 Voluntary Right of Return (New Goods Only)

For new goods, the Customer may request a return within 7 calendar days of receipt. No legal right to return exists; Studio Negativ decides at its sole discretion whether the conditions for a return are met. Goods must be returned unused, complete, and in their original packaging. Return shipping costs are borne by the Customer.

If a return is approved, Studio Negativ will issue a full or partial refund at its discretion, based on the condition of the returned goods. A minimum processing fee of CHF 20.– will be deducted in all cases.

Note: Swiss law does not provide for a statutory right of withdrawal for online purchases (unlike EU law). The above return option is a voluntary service offered by Studio Negativ and does not constitute a legal entitlement.

§ 8 Camera Rental

8.1 General

Studio Negativ offers the rental of cameras, lenses, and accessories (hereinafter "rental equipment"). Ownership of the rental equipment remains with Studio Negativ throughout the rental period. Subletting or transfer to third parties is not permitted without the prior written consent of Studio Negativ.

8.2 Booking & Contract

Rental bookings may be made online via the web shop, by e-mail, or in person at the store. The rental agreement is concluded upon written confirmation by Studio Negativ. Studio Negativ reserves the right to decline a booking without stating reasons.

8.3 Identification & Deposit

For every rental booking, the Customer is required to provide a copy of a valid government-issued photo ID (identity card or passport). The copy is used solely for identification and security purposes and will be destroyed in compliance with data protection law upon conclusion of the rental.

In addition, a deposit equal to 100% of the current market value of the rented items must be provided before handover of the rental equipment. The deposit may be paid in cash or by bank transfer. It will be refunded promptly upon return of the rental equipment in undamaged and complete condition. In the event of damage, the deposit will be applied against any claims for compensation.

8.4 Handover & Return

Rental equipment is handed over on the agreed date at the store at Jurastrasse 1, 3013 Bern. The Customer must inspect the rental equipment upon collection for completeness and condition and raise any objections immediately. By accepting the equipment, the Customer confirms its described condition.

The equipment must be returned no later than the agreed return date during the store's regular opening hours. Returns outside of opening hours are only permitted following prior explicit discussion and written consent from Studio Negativ. The equipment must be returned in a clean and complete condition. Late returns will be charged at the pro-rata daily rental rate. If Studio Negativ loses subsequent rental income due to the delay, the Customer shall be liable for such loss.

8.5 Liability & Damage

The Customer bears full responsibility for the rental equipment from the time of handover until its complete return. Damage, loss, or theft is entirely at the Customer's expense. Studio Negativ does not take out insurance for the rental equipment on the Customer's behalf; it is the Customer's own responsibility to arrange appropriate liability or equipment insurance.

Damage or loss must be reported to Studio Negativ immediately and no later than upon return. Compensation is based on the replacement value of the rental equipment at the time of the incident. Studio Negativ is entitled to retain the deposit to cover compensation claims and to pursue any additional loss separately.

8.6 Cancellation

Rental bookings may be cancelled free of charge up to 48 hours before the agreed rental start. Any deposit already paid will be refunded in full. For cancellations within 48 hours of the rental start, or in the event of a no-show, a cancellation fee of 50% of the rental price will be charged. The deposit will be refunded less the cancellation fee.

If Studio Negativ is unable to provide the booked rental equipment due to unavailability, the booking will be cancelled at no charge and the deposit refunded in full. Further claims by the Customer are excluded.

§ 9 Repair Service

9.1 Repair Request & Order Acceptance

Studio Negativ offers repair and service work on cameras, lenses, and related accessories. All repair requests must be submitted exclusively via the official form on the Studio Negativ website under the category "Repair". Requests made by e-mail, telephone, or any other channel do not constitute a repair order.

Sending in devices is only permitted following Studio Negativ's express written approval. Shipments received without prior authorisation will not be accepted or will be returned at the Customer's expense. Studio Negativ will acknowledge receipt of the repair request and provide a response within 7 business days.

9.2 Diagnosis & Quote

Upon receipt of the device, Studio Negativ will carry out a diagnosis. The Customer will receive a written quote (KV) within 7 to 14 business days of the device being received. Work will only commence upon the Customer's express written consent to the quote.

A diagnostic fee is charged for the assessment and inspection of the submitted device. Depending on the scope and number of items to be assessed, this fee ranges from CHF 45.– to CHF 85.–. The diagnostic fee is due regardless of whether a repair is carried out. If the repair is commissioned, 50% of the diagnostic fee will be credited towards the repair price.

The quote is binding on Studio Negativ for 30 calendar days from the date of issue. If the Customer does not place an order within this period, the full diagnostic fee remains due and the device will be returned at the Customer's expense. If the actual scope of work during the repair exceeds the quoted amount by more than 20%, Studio Negativ will notify the Customer immediately and obtain renewed written approval. No additional work will be carried out without such approval.

9.3 Submission & Shipping

Devices may be submitted in person during opening hours at the store. For postal submissions, the shipment must be sent by registered mail (with proof of delivery). Studio Negativ accepts no liability whatsoever for shipments in transit, in particular for loss, damage, or delay. This expressly includes unregistered shipments, for which no liability is accepted under any circumstances. The Customer bears the full transport and loss risk until the device is received by Studio Negativ, and is strongly advised to insure the shipment for its full replacement value.

9.4 Execution & Warranty

Studio Negativ carries out repairs to the best of its professional knowledge and using appropriate materials. Studio Negativ reserves the right to consult specialist third parties or collaborate with recognised specialist workshops for specific work. The quality of all repair work is guaranteed by Studio Negativ in all cases.

A 3-month warranty from the date stated on the service certificate is granted on the repair work performed. This warranty covers only the defects remedied during the repair and expressly excludes consequential damage caused by improper use, external influences (including water, moisture, heat, cold, impact), and consumable parts.

Studio Negativ is not liable for pre-existing damage unrelated to the repair, nor for data loss on storage media. Customers are strongly advised to back up all data before submitting their device.

9.5 Collection, Return & Storage Fees

The Customer will be notified by e-mail or telephone once the repair is complete and the device is ready for collection. The device may be collected in person during opening hours, or returned by post at the Customer's request, with shipping costs charged to the Customer.

If the device is not collected within 30 calendar days of notification and no return is arranged, storage fees of CHF 15.– per commenced calendar week will be charged from the 31st calendar day onwards. After a further 60 calendar days, Studio Negativ is entitled to return the device at the Customer's expense. If no valid return address is available or return is not possible, Studio Negativ is entitled to dispose of the device at its own discretion.

9.6 Exclusion of Liability for Force Majeure

Studio Negativ handles submitted devices with due care. Studio Negativ's liability for damage to a submitted device not caused by the repair work is limited to the current market value of the device. Studio Negativ accepts no liability for damage to submitted devices caused by events of force majeure occurring while the devices are on Studio Negativ's premises, including in particular fire, water damage to the building, natural disasters, burglary, or other events beyond Studio Negativ's control.

§ 10 Limitation of Liability

10.1 General Exclusion of Liability

Studio Negativ is liable for damages only in cases of proven intent or gross negligence. Any liability for slight negligence, indirect damages, consequential losses, lost profits, data loss, and damage caused by third parties (including shipping carriers, payment providers, or manufacturers) is excluded to the fullest extent permitted by law.

Studio Negativ's total liability towards a Customer is in any case limited to the value of the specific order, rental, or repair from which the damage arose.

This limitation of liability does not apply to damages arising from injury to life, body, or health, nor to mandatory statutory liability provisions.

10.2 Website & Online Shop

Studio Negativ accepts no liability for the permanent availability, accuracy, or completeness of the content on its website or online shop. Technical interruptions, errors, or temporary unavailability of the online shop do not give rise to any claims by the Customer. Studio Negativ is not liable for any damage incurred by the Customer through use or inability to use the website, including data loss or security vulnerabilities.

10.3 Third-Party Links & Hyperlinks

The Studio Negativ website may contain links to external third-party websites. Studio Negativ has no control over their content and accepts no liability for the content, privacy practices, or availability of linked external sites. Use of such sites is at the Customer's own risk.

10.4 Technical Disruptions & Payment Providers

Studio Negativ is not liable for damage or delays caused by technical disruptions at third-party providers, in particular Wix, PostFinance, Twint, credit card providers, or other payment and infrastructure service providers. If an order cannot be processed due to such disruptions, Studio Negativ is entitled to notify the Customer and cancel the order without any claims arising as a result.

10.5 Pricing Errors

Despite careful maintenance of the online shop, pricing errors cannot be entirely excluded. In the event of an obvious pricing error — in particular where a price bears no reasonable relation to the market value of the product — Studio Negativ is not bound by the incorrect price. In such cases, Studio Negativ is entitled to cancel the order and notify the Customer. Any amounts already paid will be refunded in full. Further claims by the Customer are excluded.

§ 11 Data Protection & Privacy

Studio Negativ collects, processes, and uses personal data exclusively in accordance with applicable data protection legislation, in particular the revised Swiss Federal Act on Data Protection (FADP, in force since 1 September 2023). For customers resident in the European Union, the General Data Protection Regulation (GDPR) applies in addition. The person responsible for data protection is Luca Maselli, Studio Negativ Maselli, Jurastrasse 1, 3013 Bern, Switzerland.

11.1 Data Collected

Studio Negativ collects the following personal data: contact details (name, address, e-mail address, telephone number); order data (purchased products, rental bookings, repair orders); payment data (processed by Wix Payments, PostFinance, Twint, and other payment providers – Studio Negativ does not store full payment details itself); identification data for camera rentals (copy of photo ID, see § 8.3); and, where consent is given, e-mail address for the newsletter.

11.2 Purpose of Processing

Data collected is used exclusively for the following purposes: processing orders, rental bookings, and repair orders; communication with the Customer; fulfilment of legal obligations; and – with express consent – sending newsletters and marketing communications.

11.3 Newsletter & Marketing

Studio Negativ may offer a newsletter in the future. Newsletter subscription is voluntary and requires express consent (double opt-in). The newsletter may be cancelled at any time by clicking the unsubscribe link in any e-mail or by written notice to Studio Negativ. E-mail addresses will not be passed on to third parties for marketing purposes.

11.4 Data Sharing & Third Parties

Personal data is only shared with third parties to the extent necessary for the performance of the contract (in particular shipping carriers and payment providers). The online shop is operated via Wix Studio; Studio Negativ refers to Wix's privacy policy (www.wix.com/about/privacy) for applicable terms. Studio Negativ ensures that any third-party providers maintain adequate data protection standards.

11.5 Retention Period

Personal data is retained only for as long as necessary for the respective purpose or as required by statutory retention obligations. Business records and associated personal data are retained for 10 years in accordance with Art. 958f CO. Identification data from camera rentals (ID copies) are destroyed in compliance with data protection law upon conclusion of the rental. Newsletter e-mail addresses are stored until the recipient unsubscribes.

11.6 Data Security

Studio Negativ implements appropriate technical and organisational measures to protect collected personal data against unauthorised access, loss, or misuse. The online shop is operated via an SSL-encrypted connection (HTTPS). Payment data is processed exclusively by certified payment providers and is not stored on Studio Negativ's own systems. Despite these measures, complete protection against all cyber risks cannot be guaranteed.

11.7 Cookies & Tracking

The Studio Negativ online shop uses cookies and similar technologies deployed through Wix Studio. These serve the functionality of the shop, the analysis of user behaviour, and where applicable the display of personalised content. Upon first visiting the website, the Customer is informed about the use of cookies and may grant or withhold consent. Further information on the use of cookies is available in Wix's privacy policy (www.wix.com/about/privacy).

11.8 International Data Transfers

As the online shop is operated via Wix Studio, personal data may be stored and processed on servers outside Switzerland and the European Union, in particular in the United States. Studio Negativ ensures that such transfers are carried out on the basis of appropriate safeguards (in particular standard contractual clauses or equivalent protective mechanisms pursuant to the FADP and GDPR). By using the online shop, the Customer consents to such data transfers.

11.9 Rights of Data Subjects

Every individual has the right to obtain information about personal data stored about them, to request correction of inaccurate data, deletion, and restriction of processing, subject to any statutory retention obligations. In addition, the right to data portability applies, as does the right to withdraw consent at any time without affecting the lawfulness of processing carried out prior to withdrawal. Requests must be submitted in writing to Studio Negativ Maselli, Jurastrasse 1, 3013 Bern, Switzerland, or by e-mail to info@studio-negativ.ch. Studio Negativ will respond to data protection requests within 30 calendar days.

§ 12 Governing Law, Jurisdiction & Final Provisions

12.1 Governing Law

These GTC and all legal relationships arising between Studio Negativ and the Customer are governed exclusively by Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For customers resident in the European Union, the protection afforded by mandatory consumer protection provisions of their home country is reserved to the extent that such protection cannot be waived by a choice of law under applicable EU law.

12.2 Jurisdiction

The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is Bern, Switzerland, unless a mandatory statutory place of jurisdiction at the Customer's domicile takes precedence.

12.3 Out-of-Court Dispute Resolution

Studio Negativ is in principle willing to resolve disputes out of court and is available for corresponding discussions. There is no statutory obligation to participate in a conciliation procedure. For online disputes with customers from the EU, the European Commission's Online Dispute Resolution (ODR) platform is available at: https://ec.europa.eu/consumers/odr

12.4 Amendments to the GTC

Studio Negativ reserves the right to amend these GTC at any time. Amendments will be published on the website and take effect on the date stated. Customers will not be actively notified of changes. The version published on the website at the time of the order, booking, or order placement shall always apply. Existing contracts are not affected by amendments to the GTC.

12.5 Language

These GTC are maintained in German and English. In the event of contradictions or ambiguities between the two language versions, the German version shall prevail.

12.6 Severability Clause

Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original clause.

§ 13 Photography Courses & Consultation Appointments

13.1 Booking & Contract

Studio Negativ offers photography courses and personal consultation appointments. Bookings may be made via the contact form on the website, by telephone, WhatsApp, social media, or in person at the store. The contract is concluded upon written confirmation by Studio Negativ. Studio Negativ reserves the right to decline a booking without stating reasons.

13.2 Payment

The full course fee or consultation fee is due in advance at the time of booking. The booking is only bindingly confirmed upon receipt of payment. The payment methods set out in § 6 apply accordingly.

13.3 Cancellation by the Customer

Booked courses and consultation appointments cannot be cancelled free of charge. In the event of cancellation by the Customer — regardless of the timing — the full course fee will be retained. The Customer is free to nominate a substitute person to attend in their place. Rebooking to a different date is only possible with Studio Negativ's express written consent and subject to availability.

13.4 Cancellation by Studio Negativ

Studio Negativ reserves the right to cancel courses or consultation appointments, provided this is communicated at least 48 hours in advance. In the event of cancellation by Studio Negativ, the full amount paid will be refunded. Further claims by the Customer, in particular compensation for consequential costs (e.g. travel expenses), are excluded.

13.5 Course Materials & Equipment

Whether course materials, handouts, or equipment are provided by Studio Negativ depends on the specific course offering and will be stated in the respective course description. Unless otherwise indicated, participants are expected to bring their own camera equipment. Studio Negativ accepts no liability for damage to participants' own equipment brought to the course.

13.6 Liability & Conduct

Participation in courses and consultation appointments is at the participant's own risk. Studio Negativ is not liable for personal injury or property damage arising in connection with participation, unless caused by Studio Negativ's wilful misconduct or gross negligence. Participants are expected to treat Studio Negativ and fellow participants with respect. Studio Negativ reserves the right to exclude individuals from a course due to disruptive or inappropriate behaviour, without entitlement to a refund.

§ 14 Purchase of Second-Hand Goods

14.1 Purchase Enquiry

Studio Negativ purchases used cameras, lenses, and accessories. A purchase enquiry may be submitted in person at the store or via the contact form on the website. By submitting a purchase enquiry, the seller declares that they are the sole and unrestricted owner of the goods offered and are free to dispose of them.

14.2 Assessment & Offer

Studio Negativ will assess the offered goods and make a non-binding purchase offer. Depending on the situation, the assessment and offer may take place immediately on-site or following an assessment period. Studio Negativ is not obliged to make an offer or purchase any goods, and may decline a purchase enquiry without stating reasons.

Pricing is determined either by an offer from Studio Negativ based on its internal assessment, or on the basis of a price proposed by the seller, which Studio Negativ will consider at its sole discretion. No legal entitlement to any specific purchase price exists.

14.3 Conclusion of Contract

The purchase contract is concluded once both parties have confirmed the purchase price in writing or verbally and the goods are handed over. Studio Negativ reserves the right to adjust or withdraw its offer following a thorough assessment if the goods do not correspond to the described condition.

14.4 Payment

The purchase price is paid immediately upon conclusion of the contract and handover of the goods, either in cash or by bank transfer. A receipt will be issued for cash payments. Studio Negativ reserves the right to pay by bank transfer only for higher amounts.

14.5 Ownership Guarantee & Seller Liability

The seller warrants that the goods sold are free from third-party rights, have not been stolen or otherwise unlawfully acquired, and are not subject to any ongoing lease obligations or retention of title. Studio Negativ is entitled to refuse the purchase and notify the competent authorities if there is reasonable suspicion of unlawful origin.

If it subsequently transpires that the goods were stolen or subject to third-party rights, the seller is obliged to repay the purchase price received in full and to indemnify Studio Negativ against all resulting third-party claims.

14.6 Refusal & Return

If Studio Negativ declines the purchase or no contract is concluded, the goods will be returned to the seller immediately. For goods submitted by post, return shipping costs are borne by the seller. Studio Negativ accepts no liability whatsoever for damage or loss arising in connection with the assessment, storage during the assessment period, or inbound or return shipping of the goods. The seller bears the full risk for shipping and is advised to insure the shipment for its full replacement value.
